I thought I was hitting a wrong key lately.

Just did a test with a Comcast, MPG2, recording of "Mission 
Impossible".

I thought it turned off over a commercial break.

It is intermittent. I jumped past a commercial and CC turned 
off. I jumped back and repeated and CC stayed on. It happens 
about 1 in 4 times over the same commercial break.  I normally 
watch at 2X playback speed.
