Okay, so I changed the order of Live TV tuners to be the opposite of the scheduled tuners. I tested this morning and I was watching a channel that started recording the same channel at the top of the hour and it worked as expected.  My Live tv was the last tuner and the recording was on the first tuner.  No issues with Kodi this time either.  I've reported the Kodi crash to their forum.
