                                                Further info - friend
                                                tried a ppa kernel
                                                2.6.32-020632 which
                                                worked perfectly but had
                                                no Lirc support. So
                                                issue is that support
                                                for HVR-1700 PCIe cards
                                                is broken in Mythbuntu
                                                9.10. Surprised this
                                                hasn't popped up before.
