Rock, met hard place.  CableCARD certification
for copy-once/never content requires protected path.

If MythTV users want to change the rules, they
will need to step up and work at a different level
(Congress for a change in copyright law that
currently gives content owners rights in how one
can access their works, or the content providers
themselves to eliminate the DRM requirements
on their content).  As you, yourself, said, any
alternative PVR manufacturer is going to have to
follow the rules if they wish to obtain the content
(unless you have a quantum computer in your
back pocket to break the CableLabs root certs).
