Well, not normally (although better supported would have value), but.....

The Hauppauge "leak" was filled with proprietary code licenses.
It is not open, and you likely do not the right to use it (unless you
get your lawyer to produce a finding that you can ignore the license
and proprietary/confidential words).

Some people will be comfortable using such unlicensed codes, and
some people will not be, and some people will be totally oblivious
that they have a decision to make.

But the bottom line here is that there is no current decision about
using an "open source" driver to make.  There is none.
