Actually the ATSC spec was expanded in 2008 to include H.264.
ATSC Standard A/72 part1:2008

I suspect the issue with implementing it is all the people who had
just recently swapped out sets for MPEG2 only capable devices.
The above standard makes a reference to this in the introduction.
