I don't know what's causing your problem. It works for me on Debian.
mythtered% uname -a

x86_64 GNU/Linux
mythtered% dmesg | grep hdpvr
[ 4.709885] hdpvr 3-5:1.0: firmware version 0x1e dated Mar 7 2012 08:25:15
[ 5.229063] hdpvr 3-5:1.0: device now attached to video0
So it's not a general problem with kernels beyond 3.8.
