The FCC separable security waiver for one-way devices (i.e. DTAs) was
granted to almost all the usual vendors of the equipment (Cisco,
Motorola, Pace, etc.) in early 2009 (with the usual caveats and
requirements that all waivers have in one form or another).  As you say,
the SCTE-52 encryption is more appropriately called "privacy mode".
In late 2010, the FCC granted a waiver for HD-DTAs.  There is a
completely different waiver working its way though the process
regarding downloadable security which is currently being done
provider by provider.
