I'll repeat what I said before.

In the US, and most other major countries where Microsoft
operates, one can obtain OEM Windows and provide
it with hardware.  While typically that is a "system",
there are allowances for other hardware such as hard
drives.  As I recall, you had to pre-install the software
on the hardware you sold.  Anyone selling OEM
Windows without pre-installation on (real) hardware
is in violation of their agreements with Microsoft.
Can people "get away" with it?  Probably.  "Legal"?
Probably not legal if your country follows laws similar
to the UCC (and many western countries do) where
contracts are expected to be enforceable.  Your
country laws will vary.

So yes, the executive summary is that the OEM
software you point to for $100 is not legal (with the
usual caveats of there are always edge cases
and special circumstances).
