I dont buy that argument, drivers shouldnt be in the kernel, they should
link to the kernel, nvidia doesnt release their source.

My issue is that vendors of equipment dont often maintain their drivers for
linux well enough, dont offer them via a PPA and so you're stuck to an old
kernel, old distribution version or some other issue, then they dont think
they have sold enough to linux users so can support completely.
Opensourcing protects us from that (at least to the degree that someone
could maintain them if someone with the time, skill and inclination were
available).
