1) We don't have any 0.23 builds with that patch.

2) The patch came from a user who submitted it to our tracker as well as
upstream's from someone in the community.  We applied it in the interim as
it is a better situation than no V4L support w/ 2.6.38.  As soon as there is
something similar in 0.24-fixes we'll drop it.
