Quite correct, but it;s even worse than that.

Exceptions are granted to the DMCA, and an attempt was made to obtain  
such an exception for the purposes of backing up legally-purchased  
DVDs. This was turned down just this past year.

So it is not a "slipup" or "omission" in the law, this is actually  
what they intended to happen.
