I don't know for sure about the TiVo. I do know the standalone series  
2 TiVo would refuse to transfer some programs to a PC using their  
software, so I suspect the DVD-burning unit *could* refuse some  
programs, whether they are using that ability or not I don't know.

I'm also not positive that there are *no* tuner cards that encode  
directly to DVD format, but I've never seen one. The Plextor Convert- 
X units are advertised to dub to DVD but mine needs software to do  
the proper encoding after capture.

A standalone DVD recorder along with a (probably illegal in the US)  
Macrovision-deleter will record any analog video direct to DVD.

MythBurn does a good job of recording any recorded program to DVD,  
and I understand that MythArchive is an improvement on that.

My feeling is that as long as I am not distributing or profiting from  
my recordings I'm probably safe from a knock at my door.
