Not quite right. I am a FCC licenced radio operator (ham radio). The fcc has
the right to regulate the avaliable frequences, power levels and modulation
systems for radio trasmitters used inside the usa. It has nothing to do with
state lines. Radio signals dont obey state lines, only propagation. As far
as modulation, the fcc cannot by itself add the requirement for a flag in an
already existing modulation scheme it currently can only indicate what
modulation schemes can be used on a given frequency. For the over the air tv
broadcasts currently NTSC is allowed (I think, not a lawyer). 
I agree that the next attempt will be with congress. There will probably be
a parrallel attack to get the a second standard passed. Perhaps something
along the lines of NTSC and NTSC-PR for property rights enabled and try to
get that enabled as a second standard. Then they can force us to use the new
standard in preference to the old one and of course and any device thats PR
enabled will obey a bunch of flags. 
Other than the FCC madate portion of my soapbox the rest is purely my
opinion.
