It may not be, but then it's not being distributed. The problem is that 
nothing available with an appropriate license matches the metrics or style of 
Arial. The themes in question were carefully aligned against that font, a 
change of font metrics would require the theme be almost entirely re-written 
changing the look and design.

In the case of Terra it was an unfortunate mistake, but an irreversible one.
