Likely an oversight somewhere. Other than the OTA channel
broadcasts (FCC rules), no provider is under any particular
requirement to set any particular copy protection status, other
than what they negotiate with the content provider. That is
why TWC can choose to set copy_once on pretty much
everything, and Comcast can choose to set copy_freely on
pretty much everything (exceptions noted). Fox (the larger
corp) has consistently asserted that they have not been
appropriately compensated for their content, and have
recently been the most aggressive in trying new ways to
monetize that content. Whether they are right, or wrong,
and whether the approaches they are taking is good or bad
does not matter. Their content, their rules. Like being the
first airline to raise prices on a route, they may be forced
to back down, or everyone else may follow their lead, or
maybe they will end up staying the outlier (Fox certainly
does not mind being considered special).
