TiVo and ReplayTV had a bunch of patent lawsuits, and eventually
settled (probably agreeing to various cross license deals).  DirectTV
bought a lot of the assets quite some time ago as ReplayTV finally
withered away.  Who owns what rights to what patents is
probably difficult to determine, but those are certainly the likely
players.

Regardless, one of the reasons to move to commercial detection
by sufficiently advanced apes is that detection is hard to get right
due to the constant back-and-forth between those that want to
detect (and skip) and those that want to block detection (and
skipping).
