Per the FCC rules, OTA (basically) cannot protect
anything (yeah, various experiments exist), per
47CFR76.1904(a).

Most MSOs, however, operate under the "consent"
rules regarding carriage of the local OTA channels, so
that local affiliates have additional capabilities regarding
their negotiated rules and rates.  And while I have no
doubt that all parties intend to meet their contractual
obligations, we (or, at least I) have no idea what those
are (I do not think I have ever seen a commercial
broadcaster publish their contract with the local cable
company).  Whether the result in this case was as
contracted, or a failure to properly implement, will likely
require long hours of conversation with one or more of
the MSO, the affiliate, and/or the FCC, all moving at
glacial speeds.

Where OTA is an option, it is often a very attractive
option to add to the mix (often higher quality too).
