My take on the matter is that the courts decided a long time ago that
due to copyright law, cable tv systems were a public rebroadcast..
They also decided Aereo was a cable tv dvr system, moreso than a
private video experience. Who owns the hardware, who owns the right to
capture the bits that make up the copyrighted show, and then re-send
them?  This is the point they made...

If you own the hardware, and privately make something available for
yourself, this is well enough within your fair use rights.. Aereo was
a bit outside of that IMHO.  Sadly, whereas cable and DTH satellite
have clout and money to have rules favor their business model, any
legal attempts to license content on this entirely viable platform
would dry up immediately.  The industry hated them, and sadly
consumers lost a choice in this shark-eat-fish industry.

I'm quite sad at the outcome myself.
