And that would depend on what the poster meant when
he said a "private Aereo".  There are interpretations that
imply that the content distribution would be more than
a local household.  In which case it may no longer be
a private performance.  Or maybe it is.

As with much else, it is all in the details.  And conclusions
without an agreed upon set of facts are always messy.
