Your jurisdiction will vary, but in many places in the US such
activity has been classified as theft of service. Various
penalties may apply should one be identified as accessing
services you are not paying for (again, your jurisdiction may
vary).
But such activity also has other consequences, and it is one
of the reasons that the MSOs lobbied so hard with the FCC
to allow them to encrypt all basic, and why (when the rules
are approved) it will signal beginning of the end of usefulness
of the non-CableCARD clearQAM capture devices.
