The OEM copies can be sold *with hardware*
(and not without). There is a list of what they
can be sold with (i.e. systems, hard drives,
some other things), and there was an attempt
to prevent people selling them with things like
50 cent cables (but I do not have the OEM rules
in front of me at the moment). Not all people
(re)selling OEM copies on eBay are following
all the Microsoft rules. Your country legal
system will vary as to the enforcement
capability of those rules by Microsoft.
