I solved this.  The staged driver that comes with kernel 2.6.38 was not 
as robust.  Just for fun, I downloaded the staged driver contained with 
kernel 2.6.39 which has been updated quite a bit.  It compiled fine 
against 2.6.38 source and is working well.

Hopefully this helps someone else!
