It could even be more complicated.  nVidia requires (per their license)
that the end user agree to certain conditions.  Your typical GPL'd
distro cannot agree to a restrictive license for the end user, so may
be unwilling to redistribute it.

As with much else involving patents, copyrights, trademarks,
licenses, contracts, etc., details matter, and your lawyer may
come to completely different conclusions than someone else's
lawyer.  Those that want to avoid lawyers may choose to stay
far away from the thin lines and grey areas that may result in
large costs.
