For better or for worse, if we're going to put more flexibility in the
hands of the themers, that means letting them decide how they like
things, and what one might consider a usability bug the author might
consider his mona lisa.  :)

That said, I've made the author aware of your concern and I'll let him
respond in the thread or with patches or with silence as he likes. :)
