ok, in case anyone else has this issue, here's where it came form:
Utilities/Setup > Setup > General > Audio System (4th page)
Check Advanced Audio Configuration on, Check Override SRC quality on,
and set the Sample Rate Conversion to Disabled
apparently Myth's builtin sample rate conversion is broken with some
combination of what I am trying to do (FLAC/MP3 playback via hdmi)

then, I also have this in my /etc/asound.conf
