Have you tried to see if it will run under windows? As for the 
warranty,it's for two years,I got mine on the initial release and my two 
years won't be up until June...I would check with them to see if the 
warranty is still valid...
There is an IRC channel (#hdpvr) that was set up when Janneg,wrote the 
driver..Perhaps he or John Poet can help you (It don't cost anything to 
ask)...
I would first see if it works under Windows...I have been running it 
since the first driver came out  and for the most part it has run well...
