In the case of movies from the major studios, I'd guess there is some 
agreement that allows the MPAA to act as the right holder's agent to some 
extent. There may be some smaller independents without such agreements, 
but if the MPAA has good lawyers they would only sue in the case of a rights 
holder they have a contract with, otherwise I don't think they would have 
"standing" to sue at all (IANAL).
