I've had this problem, too; I use kernel 2.6.16.39 with a pair of
pcHDTV HD-3000 for OTA reception. I do pretty much the same thing via
cron twice a week (unload/reload cx88-dvb; I haven't needed to deal
with cx8802/cx88xx).

I do restart mythbackend as well.

The script first checks to see if anything is being recorded before
continuing (it requests http://localhost:6544/xml and scrapes the
output for active encoders).
