Greg,  i think it probably has a lot to do with the shows you're
recording/watching: American Idol, the smurfs (!?!?!)...  i'm pretty
sure the developers put clauses in the code that screws up commercial
detection for shows such as these. ;)

actually it does appear to depend on what shows are being recorded. 
some work better than others partially because those are the shows
that the devs watch and test on regularly.  others work well because
they conform to some sort of standards, if there is any such beast. 
you may have to bribe one of the devs to spend some time with American
Idol to determine if the show/network is doing something goofy
before/during/after a commercial break...
