Besides, that's how it works--the newest rule wins when there's a tie.  
What the reporter probably doesn't understand is that different 
recording rule types have different prioritization and there are many 
other criteria that affect recording priority--not just the 
rule-specified priority--so the rules were not equal recording priority.
